A ruling of the Senate of the Supreme Court has come into force in a complex public procurement dispute in which our colleagues, Pēteris Serģis and Juris Balodis-Bolužs, attorneys at law, successfully represented the state-owned LLC “Latvijas Valsts ceļi” (Latvian State Roads) in a dispute with the association of persons SIA “STRABAG” and SIA “VIA” in connection with the open tender “Reconstruction and resurfacing of the section of the main national highway A13 Russian border (Grebņeva)-Rēzekne-Daugavpils-Lithuanian border (Medumi)” announced by the state-owned LLC “Latvijas Valsts ceļi”.
During the procurement process, the client, the State LLC “Latvijas Valsts ceļi” (Latvian State Roads), had doubts about the compliance of the tenderers’ bid security with the requirements of the tender statute, and the dispute about the right of the client, the State LLC “Latvijas Valsts ceļi”, to receive the security provided by a bid security prepared in accordance with the requirements of the tender statute, was finally settled during the litigation.
