Better prospects for WFO claims in English courts

A recent case in the High Court suggests that English courts may be willing to impose a positive mandatory order requiring a defendant to transfer its assets into the jurisdiction when subject to a worldwide freezing order (WFO). This step shows a possible increase in the protection available to claimants. However, the hurdle to overcome in order to obtain a positive mandatory order of this type is high and it appears that several requirements must be met before the court may be willing to grant the order.
